Position Description
The Senior Counsel - Litigation is principally responsible for managing BMC's litigation globally, advising on matters of potential litigation risk, legal and regulatory compliance and advising the company's finance department related to legal contingencies.
Responsibilities: ? Exercise oversight responsibility for managing BMC's global litigation. ? Advise management with regard to matters that may include or evolve into litigation risk. ? Partner with Internal Audit and Compliance & Ethics departments on investigations and reviews into internal policy and regulatory compliance matters. ? Partner with Chief Intellectual Property Counsel on IP litigation and pre-litigation matters. ? Directly manage commercial litigation matters including warranty claims, contract disputes and third party subpoenas. ? Supervise Labor & Employment Counsel and provide guidance on significant employment matters. ? Lead Legal Department Enterprise Risk Management including interacting with corporate ERM department and conducting Legal Department legal and regulatory ERM workshops and assessment process, including updates. ? Tracking and monitoring all global litigation matters and reporting to General Counsel and Finance personnel financial contingencies related to pending or threatened litigation. ? Work with Corporate Governance personnel, Finance personnel and outside auditors with regard to disclosure of matters of potential materiality in the areas of pending or threatened litigation. ? Conduct due diligence related to pending or threatened litigation risk with regard to potential mergers or acquisitions. ? Manage costs and fees related to litigation in line with budgetary requirements. ? Apprise General Counsel of all matters of significance related to pending or potential litigation.
Supervisory Responsibilities: Responsible for the overall coordination, direction, evaluations and performance of Labor & Employment Counsel and Senior Paralegal - Litigation. Supervisory responsibilities will be carried out in accordance with applicable legal and regulatory directions and BMC policies. Supervisory responsibility will include oversight of the planning and placement of employees, assigning and directing work, appraising performance, rewarding and counseling employees, addressing concerns and resolving problems. Education/Training Required:
JD from accredited US law school with top academic credentials 10+ years experience in litigation practice with emphasis on areas set out in Job Function & Responsibilities. Houston based position
